If you do not agree unconditionally to all provisions contained herein, you are strictly prohibited from accessing or using the Service and must terminate your session immediately.

You represent and warrant that you are at least eighteen (18) years of age (or the legal age of majority in your jurisdiction) and possess the full legal capacity to enter into a binding contract.

2. Strict Disclaimer: No Financial, Investment, or Brokerage Advice

The content, signals, screener data, algorithms, indicators, formulas, and visual analytics provided by Swyngr are generated algorithmically using mathematical metrics (e.g., standard deviation, moving averages, Relative Strength Index, Bollinger Bands, Keltner Channels, and public regulatory filings).

• No Individualized Recommendations: No communication, algorithm, or feature on Swyngr is tailored to, or takes into account, your individual financial circumstances, risk tolerance, net worth, investment objectives, or financial needs.

4. Simulation & Educational Nature of "The Arena"

"The Arena", virtual bankrolls (including default $25,000 balances), paper trading portfolios, Time Machine replay simulations, and win-rate statistics available on Swyngr are 100% simulated, fictional, and paper-based.

• Hypothetical Performance Limitations: Simulated results have inherent limitations. Unlike real market trading, simulated trades do not represent actual executions and cannot account for real-world market friction, including bid-ask spreads, order execution delays, exchange fees, liquidity depth, or psychological emotional pressure.
• No Guarantee of Real-World Equivalence: Successful outcomes, high win rates, or profits accumulated in The Arena do not correlate to, imply, or guarantee profitability when trading with real capital.

5. Market Data Accuracy & "As-Is" Provision

Market data, End-Of-Day (EOD) candle quotes, SEC Form 4 insider transaction reports, congressional STOCK Act filings, and calculated indicators are retrieved from third-party public data providers (including Polygon.io and SEC EDGAR).

While we strive for technical precision, Swyngr makes no representations, warranties, or guarantees regarding the completeness, accuracy, timeliness, reliability, or error-free nature of any market data or calculations. Market data may be delayed, cached, estimated, or subject to upstream provider outages.

6. Limitation of Liability & Release

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW:

IN NO EVENT SHALL SWYNGR, ITS FOUNDERS, OPERATORS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, INABILITY TO USE, OR RELIANCE UPON THE SERVICE.

THIS EXCLUSION OF LIABILITY INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF CAPITAL, TRADING LOSSES, LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, COMPUTER FAILURE, OR SYSTEM MALFUNCTION, EVEN IF ADVISED OF THE POSSIBILITY THEREOF, REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).

You agree to defend, indemnify, and hold harmless Swyngr, its subsidiaries, affiliates, officers, agents, partners, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) any live trading decision or financial transaction you make; or (d) your violation of any applicable federal, state, or international securities regulation.

8. Proprietary Rights & Permitted Use

All software code, user interface designs, mathematical indicator pipelines, branding, logos, trademarks, and educational documentation associated with Swyngr are the exclusive intellectual property of Swyngr. You are granted a personal, revocable, non-exclusive, non-transferable license to access the platform for individual, non-commercial educational use. You may not reverse-engineer, scrape, redistribute, or resell the platform's algorithms or data feeds without prior written consent.

9. Third-Party Advertising & Affiliate Links

The free tier of Swyngr displays third-party sponsor advertisements and promotional market insights (e.g., from financial publishing partners or analytics networks). Swyngr does not endorse, verify, or warrant the products or claims made in third-party advertisements. Engaging with sponsored links is at your sole discretion and risk.
